A recruiter's viral TikTok arguing that bringing an iced coffee to a job interview appears unprofessional has prompted a legal look at how such perceptions affect hiring decisions. Employment attorney Erin Shrum of FordHarrison notes that while beverage choice is not a protected class, employers who reject candidates over it must document a legitimate, nondiscriminatory reason and apply that standard consistently across all applicants. Inconsistent application, such as rejecting one candidate but hiring another who made the same choice, could invite discrimination claims. Shrum recommends structured interviews with standardized questions and scoring rubrics tied to job-related criteria to keep hiring decisions defensible and objective.
