BYOD Policies Can Shield Employers From Personal Device Discovery

Well-drafted BYOD policies may help employers resist litigation demands to search employee personal phones.

HR Solution Journal News Desk

A 2025 Middle District of Tennessee ruling offers HR leaders a practical framework for limiting discovery exposure tied to employee-owned devices. The court declined to require an employer to search personal phones, finding the company lacked legal or practical control over those devices. Key policy provisions mattered: inspection rights were limited to security compliance, business communications were routed through company systems, and personal devices were excluded from definitions of company property. HR teams should review BYOD policies now, narrowly defining inspection rights and requiring business communications through employer-managed platforms. Note that opposing counsel can still subpoena employees directly under Rule 45.
